Privacy Policy

How we collect, use, store and share personal information, including the details you tell us about the person your song is for.

Who we are

VERSORIA is operated by Nicholas Mainwaring, sole trader (ABN 38 255 793 049), trading as NJM Digital and VERSORIA, New South Wales, Australia ("we", "us"). Contact us about privacy at hello@versoria.com.au.

Privacy law

We handle personal information in accordance with this Privacy Policy. Where the Privacy Act 1988 (Cth) applies to us, we comply with the Australian Privacy Principles. We aim to apply the same privacy standards to all personal information we handle even where the Privacy Act does not legally require us to do so.

What we collect

Order details: your name, email address, the occasion, and the answers you give in our story form.

Payment: payments are processed by Stripe. We receive confirmation of payment, the amount and limited card details (e.g. card brand and last four digits). We never see or store your full card number.

Offer sign-ups: your email address and whether you agreed to marketing, with the time and wording of that consent.

Technical and usage data: with your consent, first-party analytics about pages viewed, samples played and steps completed, and (with analytics consent) the campaign (UTM) parameters and landing page that brought you to us. We may process an IP address for security, rate limiting and fraud prevention. Where we retain a derived identifier, we take steps to reduce its ability to identify an individual.

Communications: messages you send us, including revision requests.

Information about other people

Your answers may include personal information about the recipient or other people, such as their name, relationships, memories and places that are meaningful to them. Please provide only the information reasonably necessary to create the gift.

Do not provide sensitive information about another person (such as health information, religious beliefs, racial or ethnic origin, sexual orientation, sex life or political opinions) unless that person has expressly agreed to you providing it to us for this purpose.

Where possible, avoid unnecessary identifying details such as surnames, home addresses, phone numbers or other information that is not needed to create the song.

Because songs are usually surprise gifts, we don't contact recipients before delivery. Recipients can find this policy through a link on the song's delivery page and can contact us about their information at any time.

Why we use it

To create, deliver and support your song (including drafting lyrics, generating music and artwork, reviewing quality, revisions and customer service).

To process payments, prevent fraud and abuse, and keep records required by law (e.g. tax records).

To send emails about your order. We send marketing emails only if you opt in (for example, the offer emails and one reminder if you don't finish checkout), and every marketing email includes a way to unsubscribe.

With your consent, to understand how our site and ads perform and improve them. We never send your story, the recipient's details, lyrics or other free-text answers to advertising platforms.

Service providers and overseas disclosure

How we protect information sent overseas

We take reasonable steps appropriate to the circumstances to assess and protect information disclosed to overseas service providers. These steps may include reviewing their privacy and security practices, using contractual data-protection terms where available, restricting the information we provide and using available retention and training controls.

We do not sell personal information and we do not train our own AI models on customer stories. Where our AI providers offer controls that prevent customer content being used to train or improve their general models, we enable those controls. Our providers may retain limited information for security, abuse prevention or legal purposes as described in their applicable terms.

How long we keep it

Story answers, lyrics, artwork and audio: kept for 24 months after delivery so you can re-download your song and request support, then deleted.

Unpaid or abandoned orders: deleted after 30 days.

Analytics events: deleted after 14 months.

Financial and tax records, such as payment amount, transaction date, invoice information and order identifier, may be retained for the period required by law (generally 5 years). This does not mean we retain your full story, lyrics or audio for that period.

Access, correction and deletion

You can ask to access or correct your personal information by emailing hello@versoria.com.au. We'll respond within 30 days.

You may ask us to delete personal information associated with your story or song. We will comply where reasonably practicable, subject to information we need to retain for legal, fraud-prevention, dispute-resolution or accounting purposes. We may need to verify your identity before acting on an access, correction or deletion request.

If a recipient or another person mentioned in a story contacts us about their information, we'll handle their request in the same way.

Security

Data is encrypted in transit, stored in access-controlled systems, and song files are private and only accessible through expiring links. Order pages are protected by unguessable links, so keep yours private. No system is perfectly secure; if a data breach is likely to cause serious harm, we'll notify affected people and, where required, the OAIC.

Complaints

Contact us first at hello@versoria.com.au. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au).
